Gr8 Mobile Service Terms 

 

These Service Terms(“Service Terms”) form an integral part of Gr8 Mobile’s Website Terms of Use (the “Website Terms”). In the case of any inconsistency or conflict between these Service Terms and the Website Terms, these Service Terms shall prevail. 

All capitalized terms not otherwise defined herein, having the meaning as set forth in the Website Terms. 

Requirements of Use of Service 

Persons using the Service agree as a condition of use that they are persons acting in their induvial, non-business capacity and are 18 years of age or older. You must comply with all U.S. or other export and re-export restrictions that may apply to goods, equipment, technology, and services.  

 

We are under no obligation to provide a quotation or accept your Device for purchase, which shall be entirely at our discretion. We only accept Devices from individuals (and not businesses) and each individual may offer to sell to use more than of five (5) pieces of Devices in any six (6) month period. 

Fitness for Sale 

You must have all clear and unencumbered right, title, and interest in all Devices you seek to sell to Gr8 Mobile and must have the right to pass such right to us upon sale as set forth in these Service Terms, including third-party software that may not be transferred or for which royalties are dueAll Devices must be able to be activated for new service. All Devices (and sale and shipment thereof to Gr8 Mobile) (i) must comply with all applicable laws, statutes, ordinances, including without limitation all import and export laws and (ii) shall not be counterfeit, stolen, or fraudulent. It is your responsibility to discontinue phone, Internet, and/or any similar service on your Product prior to selling it to Gr8 Mobile. Gr8 Mobile is not responsible for any service charges related to your Product, whether you incur such charges before, during or after your use of the Service. It is also your responsibility to remove any security codes that would prevent use of any Product. 

We may check all Devices against lost and stolen property databases (at our discretion) and will notify you if we find any record of such Device that indicate it is lost or stolen. In this scenario, we will suspend or terminate your Account and all the current Service transactions, until such time as you are able to prove to us evidence to our full satisfaction in our sole discretion that you are the legal owner of the Device. 

 

If any ownership query cannot be resolved, we may pass such Device to relevant law enforcement agencies or destroy it and will not be liable to you for any compensation payable in connection with such Device. Furthermore, if we have sent you any payment for such Device, you shall return such payment to us within three (3) days of our requestYou expressly agree that we may pass your details to relevant law enforcement agencies or other relevant third parties (including mobile network providers and insurers). You will cooperate fully with us in any such circumstances. The purpose of passing such data to third parties is the prevention of crime. 

Condition Criteria  

Gr8 Mobile uses three (3) basic Device condition criteria to grade Device for Trade-In, ranging from "Working Condition," “Minor Damage Condition,” and “Broken Condition." 

Gr8 Mobile's Product definitions are as follows:  

  • Working Condition: Device is in excellent cosmetic condition and fully functional. All working devices will be put through an internal 56-point test, which will determine the cosmetic condition of the Device: Excellent, Very Good, Good, Poor, or Very Poor. 

  • Minor Damage Condition: Device is fully functional but in a broken cosmetic condition. 

  • Broken Condition: Device does not turn on, one or more functions are non-operative, or the Device has serious physical damage that inhibits use (e.g. broken or cracked screen or missing parts). 

The above definitions are broad guidelines. More specific and current condition definitions serve as the effective conditionsfor the applicable Device (see Device Condition Criteria, the “Device Condition Criteria”). Device Condition Criteria are subject to change at Gr8 Mobile's sole discretion. If you are uncertain about your Device’s condition, please contact Gr8 Mobile's customer service. 

Original Offer; Delivery 

When you enter the details of the Device on the Website, we will provide you an offer to purchase such Device from you, based on the Device Condition Criteria you selected as determined in our sole discretion (“Original Offer”). Upon receiving an Original Offer, you have the option of accepting or rejecting that offer. Acceptance indicates you are willing to sell your Device to Gr8 Mobile at the offered price. If you do not accept the Original Offer, the related transaction automatically expires. If you accept to the Original Offer, you must confirm this to us as per our instructions, and we will send you the means to mail your Device to us for free to be sent at our standard delivery method with standard insurance 

 

You can then send the Device to us in accordance with the delivery instructions we provide to you. You should follow all packing and shipping recommendations provided to you to avoid possible damage to or loss of the Device in transit. However, the foregoing, the cost of more secure or faster delivery shall be borne by you. You will be responsible for ensuring that any Device is able to be sent safely within U.S. Postal Service terms (including regarding lithium batteries). If this is not possible, please contact us for further assistance at info@gr8mobile.us. When we provide free delivery services for your Device, limited insurance cover up to the standard U.S. postal service tracked parcel service is included. However, we do recommend that you return Devices that carries significant value using special delivery with cover up to the value of the Device, at your cost. 

 

The Original Offer is valid for 14 days from your receipt of such offer, and, accordingly, we must receive the relevant Device(including all materials included in your description when entering your details for the device) prior to the end of such 14-day period. Your failure to include any items you related to the Device included in the details you provided uswill impact the final value of your Device and may result in a revised offer. 

 

You may withdraw or amend an Original Offer at any time before our acceptance. If you withdraw an Original Offer, you may request an updated offer or the return of the Device to you, at your sole cost and expense. Our Acceptance of an offer by us for purchase of the Equipment shall occur when we accept your offer, which acceptance shall be entirely at our discretion. 

Removing Data from Your Product 

For Devices that store files and/or personal data, you must back up and store any data you wish to keep from your Device and remove any personal information from the Device before you send your Device to us for Trade-In. Our standard practice is to remove all such data from the Device. However, we make no guarantee that we will do so. By sending us the Device, you agree to release us from any claim as to the data stored in the Device or any information on any media used in conjunction with the Device. Gr8 Mobile is not responsible for any loss you suffer due to any data that is not erased from the Device. 

Product Inspection; Offer Recalculation 

Gr8 Mobile will inspect all Devices we receive as part of the Service. When we receive the Device, we will check its condition in accordance with the Device Condition Criteria. If there is a lock on any device, we will contact you to ask for such details. If you do not respond within 5 business days or we are otherwise unable to unlock the Device, we shall return the Device to you, at your sole cost and expense. Additionally, we may need to physically open the Device assess its condition against the Device Condition Criteria. If we are unable to safely open the Device without causing damage, we will contact you to ask if you authorise us to do so. If you do not respond within 5 business days or we are otherwise unable to open the Device, we shall return the Device to you, at your sole cost and expense. 

We may then, in our sole discretion. (i) confirm the Original Offer, (ii) provide an updated offer for the Device, or (iii) reject the Device and return it to you, at your sole cost and expense. We shall communicate our decision to you within 7 business days of our receipt of the Device. If we reject the Device for any reason, the Original Offer automatically expires. Our acceptance of an offer to purchase a Device shall occur when we accept your offer in writing, which acceptance shall be entirely at our discretion. 

Recalculated Offers after Inspection 

In the event Gr8 Mobile provides you with a new offer for the Device after it has been received and inspected for Trade-In (“New Offer”), as described above, you have the option of accepting or rejecting the New Offer within 3 business days. If you do not accept the New Offer, you shall notify us in accordance with our instructions within such 3-day period. If you accept the New Offer, you will be paid in normal course and in accordance with these Service Terms. If you reject the new offer within such 3-day period, we will return the Device to you at the address from which it was originally sent, at your cost and expense. However, if you neither affirmatively accept nor reject the New Offer during the 3-day period, the New Offer will be deemed to have been accepted by you, and you will be paid the New Offer price in the normal course and in accordance with these Service Terms. 

Payment 

We aim to process payment to you within seven business days of final acceptance of offer terms. Payment shall be made to the account details that you provided when you entered details on the Website. We shall not be liable for any losses you incur by entering incorrect details on the Website. You are responsible for ensuring that you can receive emails from Gr8 Mobile, and we are not responsible for any emails that were not received by you because they were blocked or filtered as spam.  

Risk-Of-Loss; Title 

You remain responsible for the risk-of-loss for the Devices sent to use for Trade-In until delivery of the Device to us. You are responsible for any damages that may occur to you’re the your Device while in transit. We are responsible for risk-of-loss when we open the packaging containing the Device and ceases in the event were turn the Device to you for any reason. We do not accept liability if the Device is lost or damaged by third-party delivery providers. If the Device is damaged using the delivery means that we provide, you will need to make a claim against the third-party delivery providersince we are not the legal owner of the Device. 

Title to the Device shall pass to us when we process payment to youThe passing of title shall not prejudice any other rights and remedies we may have.
